TMSU drops former VP student life from lawsuit

By Jasmine Makar and Amira Benjamin

Claims made against former Toronto Metropolitan Students’ Union (TMSU) vice president student life, Koby Biya, have been dropped from a $20 million lawsuit launched by the union last year.

The lawsuit, filed in March, included allegations that Biya, along with other defendants, wrongfully interfered with the TMSU’s operations and election for personal gain. However, according to the original statement of claim, which has been obtained by The Eyeopener, Biya was not involved in any alleged financial mismanagement or fraud.

Sixteen other TMSU members were named alongside Biya in the original statement of claim for alleged corruption, fraud, breach of privacy and more.

In an emailed statement to The Eye, the TMSU confirmed that the claims have been dropped due to a settlement reached by both parties. The statement also confirmed Biya is the only defendant who has been dropped from the lawsuit, adding, “The Union is actively moving forward with the litigation against the other defendants.”

John Mather of DMG Advocates is Biya’s legal counsel. He confirmed in an email to The Eye that Biya is no longer a defendant. “A settlement has been reached with TMSU on mutually agreeable terms,” he wrote.

Mather said he could not provide additional comment at this time.

According to the Ontario Courts Public Portal, the union’s case is still active. Most of the defendants, including former TMSU presidents Ali Yousaf and Nadir Janjua, have filed notices to defend.

Court dates have yet to be announced.
